mabye you could negotiate a ransom for your hero if you don't want to lose them

Yes, again that would go in with the captured units. Personally, I'd rather get rid of an enemy's hero and cause him to buy him again therefore using resources than capture him/her and there being a chance that he/she can be recovered.
